In 2004, Akhalu moved to Leeds to study, where she was later diagnosed with kidney failure. She had a kidney transplant in 2009 and gained her stay based on the fact that immunosuppressant drugs are not easily accessible in Nigeria.
She said, "I will die if deported to Nigeria because I would have no access to immunosuppressant drugs."
The campaign for Akhalu to remain in Yorkshire received overwhelming worldwide support, with British actor Colin Firth said to have also campaigned for her stay in the UK.
On hearing news of the judgment Roseline Akhalu told her friends and supporters:
"Thank you everybody for the support, for the prayers, for the publicity, for everything. Hopefully the UKBA will let matters rest at this stage."
